Browsing and/or interacting with our website and/or application means that you accept these TCS without any reservation or objection. 
Our company reserves the right to modify or adapt these TCS at any time without prior notice. These TCS are effective as soon as they are published on our website and/or application and/or sent by any means.

By accepting these TCS, you certify that you have reached the legal age of majority in your country, state, or province of residence. If you are a minor, you certify that you have obtained all necessary rights and authorizations from your legal representatives or guardians. If you have not reached the legal age of majority, you must not use our Services. 

You are not authorized to use our Services, website, and/or application for any illegal or unauthorized purpose. 
You must not attempt to hack, alter, or misuse the functionality of our Services, send viruses, or conduct or attempt to conduct attacks against our Services. You must also refrain from compromising the integrity of our Services. 

 
These general terms govern the access and use of the ClubTonight app by users and partner venues. 

Article 2 – Content and Intellectual Property 

The content on our Services may be accessible free of charge or not. Access to some content may require you to be logged into your account or to have a valid subscription (subscriptions, restricted content, or sections). 
If access to some content requires an account or identification, please refer to Article 4 "Registration Process" to learn how to access our Services. 
The content on our Services is intended for personal, non-commercial use only. All content available through our Services is protected by copyright and/or intellectual property rights. 
Additionally, some content may be protected by other rights such as patents, trademarks, trade secrets, database rights, sui generis rights, or other types of intellectual property rights. 
Users are not authorized to reproduce, in whole or in part, any content made available through our Services. 
Users are prohibited from reproducing logos, names, visual identity, or any other distinctive sign, as well as from making slavish copies or reproductions of our Services. 
Users are prohibited from modifying, copying, translating, selling, exploiting, or transmitting (free or paid) any text, images, drawings, audio content, podcasts, or any other content available on our Services. 

Venue Listings 
ClubTonight provides a connection and information service between users and nightlife venues (clubs, bars, festivals, etc.). 
Venues are listed based on publicly available data unless they request otherwise. 

Intellectual Property :
All content (text, images, sound) is protected by intellectual property rights. Users agree not to reproduce or distribute this content without authorization. 

Article 3 – Registration Process 

Our company may or may not require user registration to access all or part of the website and/or application. 
Each registration must be made individually by each user. Sharing an account or login credentials with third parties is prohibited. 
We reserve the right to cancel or suspend access to our Services if you share your credentials with others. 

Registration 
If registration is required to access our website and/or application, users must first create an account by completing the registration form available on our website and/or application. 
Users must choose a username and password linked to a valid email address. 
Users must keep their credentials confidential at all times and must not share them with third parties. 
Our company will not be held responsible for unauthorized access, fraudulent use, or changes made to a user's account, including unauthorized access to the user’s banking data. 

Third-Party Services such as "Sign-in with Apple", Facebook, and X (Twitter) 
These third-party services may be integrated into our website and/or application to facilitate registration alongside our internal account creation process. 
These third-party providers are not affiliated with our Services, and you must refer to their respective privacy policies and terms. 
By using these third-party authentication services, you authorize these platforms to access part or all of your personal data, and this contractual relationship is beyond our company’s control. 
If you are unsure about how your data is handled through third-party authentication services, you should use our internal registration process instead.

Any venue may request to be removed or have its information modified via the “Clubs Access” form. Removal will take effect within 5 business days. 

Article 4 – Warranties 

The content available through our Services is provided "as is" and "without any warranties." 
We cannot guarantee that the content is accurate, error-free, complete, or true. 
Users access our Services at their own risk. 
Our company cannot be held liable for inaccuracies or errors in the content. 

Article 5 – Responsibilities 

ClubTonight cannot be held liable for any errors or omissions in the information provided. Each venue remains responsible for the accuracy of its own data. 

Article 6 – Moderation of Content (Chat, Comments, and Others) and User-Generated Content 

If users upload, post, or send any content via our website and/or application, they certify they hold all necessary rights and authorizations. 
Users must not publish, distribute, or upload any abusive, fake news, obscene, pornographic, illegal content, or impersonate others. 
Users must not transmit any viruses, ransomware, spyware, or similar threats. 
Users must not harass, insult, or spam others; respectful language must be maintained. 
Discrimination based on religion, race, nationality, gender identity or preference, age, disability, or any other factor is strictly prohibited, and hate speech is not tolerated. 
Our company reserves the right to delete, edit, censor, or remove user-generated content or user accounts without justification or prior warning, and no compensation will be provided. 

Article 7 – Liability 

Our company cannot be held responsible for network issues, viruses, external access, fraudulent payment use, or any technical or access problems. 

Article 8 – Third-Party Links and External Links 

Some content accessible via our website and/or application may contain third-party or external content.

All obligations and liabilities incurred prior to the termination date shall survive the termination of these TCS. 
These TCS are effective unless terminated by either our company or the user. 
The user may terminate these TCS by notifying our company or simply by ceasing to use/access our Services. 
Our company may terminate this agreement at any time without notice, and any outstanding amounts owed will remain payable. 

Article 13 – Governing Law and Jurisdiction 

These TCS are governed by Belgian law. 
Any disputes relating to the validity, interpretation, execution, or consequences of these TCS shall fall under the jurisdiction of the competent courts.

Your acceptance of these terms

By using our Services or accessing any of our websites, you signify your acceptance of this policy and Terms of Service, data protection policy, privacy policy and cookie policy. If you do not agree to these policies, please do not use our Services or access our websites but notify us directly by email at info@clubtonight.club. Your continued use of the Services or of any of our websites following the posting of changes to this policy will be deemed your acceptance of those changes or modifications.

ClubTonight is an application that lists nightlife venues for informational purposes (clubs, dance bars, festivals, etc.). The information displayed comes from public sources or is provided by the venues themselves.

Any venue may request the modification or removal of its information via the designated contact form in the section "Clubs Access".
ClubTonight commits to responding to such requests within a reasonable timeframe.

ClubTonight displays public event information and promotional flyers that are publicly available from venue websites and official social media pages. If any party believes their intellectual property rights are infringed, they may contact us at info@clubtonight.club and we will promptly remove the content. Venues may also manage their content via our Clubs Access form at www.clubtonight.club/clubsaccess

Content Removal Procedure (Notice & Takedown)

ClubTonight displays public information and promotional event materials from venue websites and social media. If any individual or entity believes that their intellectual property rights are infringed, they may contact us at info@clubtonight.club. We will promptly review and remove any disputed content.

Use of Logos and Event Flyers

Logos, flyers, and other promotional graphics are used for identification and informational purposes only. Venues may submit, update, or request removal of their visuals at any time via our Clubs Access form.
